Terms of Service

The terms that apply when you use the TalentDecrypt website and platform.

1. Acceptance of terms

These Terms of Service (“Terms”) govern your use of the website and platform operated by TalentDecrypt Private Limited (“TalentDecrypt”, “we”, “us”). By creating an account, taking a test or using the website, you agree to these Terms. If you use the platform on behalf of an organisation, you confirm that you are authorised to accept these Terms for it. Where an organisation has signed a separate written agreement with us, that agreement takes priority over these Terms.

2. The services

TalentDecrypt provides an online platform that lets organisations:

  • create and deliver skill assessments, exams and coding contests;
  • proctor those sessions using webcam, screen share, a linked phone camera, a desktop integrity agent and live proctors;
  • evaluate written and spoken answers, and run structured interviews, with the help of AI models;
  • review candidate scorecards that bring these results together.

We may add, change or withdraw features. We will give reasonable notice of changes that materially reduce the service.

3. Accounts

  • You must give accurate information when you register and keep it up to date.
  • You are responsible for activity under your account and for keeping your credentials confidential.
  • Organisation administrators control which of their users can access tests, proctoring and reports.
  • Tell us promptly at support@talentdecrypt.com if you suspect unauthorised access.

4. Responsibilities of hiring organisations

  • You decide whom to assess, what to test and which proctoring features to enable, and you are responsible for those choices.
  • You must have a lawful basis to assess candidates and to record them, and you must give candidates any notice and obtain any consent the law requires.
  • You are responsible for hiring, admission and certification decisions. Proctoring flags and AI-generated scores are aids for your reviewers and should be reviewed by a person before you rely on them.
  • You must use the platform in line with employment, anti-discrimination, education and data-protection laws that apply to you.

5. Responsibilities of candidates

  • Complete the test yourself, without help from another person or tool unless the test instructions allow it.
  • Do not copy, record, share or publish test questions.
  • Do not try to bypass, disable or interfere with proctoring.
  • Questions about your result, or about how your data is used, should go to the organisation that invited you.

6. Acceptable use

You must not:

  • use the platform for anything unlawful, or to harass or discriminate against any person;
  • attempt to gain unauthorised access to the platform, other accounts or our systems;
  • probe, scan or test the vulnerability of the platform without our written permission;
  • reverse engineer the platform or the desktop integrity agent, except where the law allows it;
  • upload malicious code, or content you do not have the right to use;
  • resell or provide the platform to third parties unless your agreement with us allows it.

7. Intellectual property

We own the platform, the website, our question library and our software. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use them for your internal purposes. You keep ownership of the questions, tests and other content you create or upload. You grant us the rights needed to host and process that content in order to provide the service.

8. Data and privacy

For candidate data, the hiring organisation is the controller and TalentDecrypt is the processor. Our Privacy Policy explains how personal data is handled, and our security and candidate privacy page explains what proctoring records. Organisations that need a data-processing agreement can request one at info@talentdecrypt.com.

9. AI features

Some features use AI models to draft questions, score answers, summarise results and conduct interviews. AI output can be wrong or incomplete. You are responsible for reviewing AI-drafted questions before using them and AI-generated scores before relying on them. The platform lets reviewers override AI scores.

10. Fees and payment

Paid plans are billed as set out in your order form or agreement. Fees are non-refundable except where the law or your agreement says otherwise. We may suspend paid features if invoices remain unpaid after notice.

11. Availability

We work to keep the platform available and to schedule maintenance outside busy periods, but we do not promise uninterrupted service. Tests depend on the candidate’s own device, browser and internet connection, which we do not control.

12. Disclaimer of warranties

To the extent the law allows, the platform is provided “as is” and “as available”. We do not warrant that proctoring will detect every instance of misconduct, that AI output will be accurate, or that assessment results will predict performance in a job or course.

13. Limitation of liability

To the extent the law allows, TalentDecrypt will not be liable for indirect, incidental, special or consequential losses, or for loss of profit, revenue or data. Our total liability arising from these Terms is limited to the fees you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify TalentDecrypt against claims arising from your breach of these Terms, your content, or your use of the platform in breach of the law, including employment and data-protection law.

15. Suspension and termination

You may stop using the platform at any time. We may suspend or end access if you breach these Terms, if your use creates a security risk, or if the law requires it. When an organisation’s account ends, we delete or return its data as set out in our agreement with it and in the Privacy Policy.

16. Governing law

These Terms are governed by the laws of India. The courts of New Delhi, India have exclusive jurisdiction over disputes arising from them.

17. Changes to these Terms

We may update these Terms. We will post the new version here with a new “last updated” date and tell account holders about material changes. Continuing to use the platform after a change takes effect means you accept the updated Terms.
